The Supreme Court issued an order today addressing implementation of the Muslim ban while the Ninth Circuit considers an appeal. Under today’s order, the government remains blocked from applying the ban to any person (including any refugee) who has a close family member in the United States, including grandparents, grandchildren, brothers-in-law, sisters-in-law, aunts, uncles, nieces, nephews, and cousins. The government also remains generally blocked from applying the ban to individuals with relationships with entities in the United States. However, today’s ruling also provides that, while the case is pending in the Ninth Circuit, the government does not need to exempt refugees with formal assurances from resettlement organizations from the ban.
